When someone says Pepsi, Coca Cola, McDonalds, KFC, Nike….does their logo first come to mind? It sure does! A picture is worth a thousand words. A company’s logo is actually their identity. Whenever the public sees a logo, they immediately associate it with a company and its products or services. As a company grows and becomes more successful, protecting the company’s image becomes much more important because if a competitor starts to use your logo they can take a part of your market share.

Similarly, trademarking in one country does not mean you are protected globally. You must register your trademark everywhere. In the United States, you can apply to the US Patent & Trade Office (“USPTO”) and once approved your certificate is issued and you are protected in the United States. In Europe, you can apply at the EUIPO for a European Union Trademark (“EUTM”). Once you are approved and the certificate is issued, then you are protected in every EU Member State. The same procedures apply for other continents.
